Items Purchased from Blue BMS (Blue BMS)
Items purchased from Blue BMS may not be covered by the manufacturer’s warranty, as Blue BMS is not an “authorized” dealer of the merchandise. However, all items are covered by Blue BMS’ one-year warranty under the terms outlined below.
Definition of Product Conditions
(a) Blue BMS’ Partner Manufacturers (BMPM): Products sourced directly from the original manufacturer, where the manufacturer’s original warranty may apply.
(b) Blue BMS’ Independent Supply Chain (BMSC): Products sourced through independent channels, including resellers, the original manufacturer (not as an authorized distributor), and online marketplaces, enabling Blue BMS to secure competitive purchasing rates.
Returns Policy
If a customer is not satisfied with a product for any reason, the return will be subject to Blue BMS’ return policy as outlined below.
Products sold by Blue BMS are subject to the return policies of the original manufacturers, if applicable. The returnability of BMPM and BMSC items varies by manufacturer. Some manufacturers classify items as non-cancelable and non-returnable once a purchase order is placed, while others may allow returns with a restocking fee. Customers should confirm return eligibility with a Blue BMS sales representative before placing an order. Items customized specifically for the customer, including but not limited to software and firmware, are not eligible for return.
To initiate a return, customers must obtain a Return Merchandise Authorization (RMA) number by contacting customerservice@bluebms.com. All returns must follow Blue BMS’ RMA process and be assigned an RMA number within seven (7) days of product delivery. After this period, the order is no longer eligible for return. Once an RMA is issued, the customer has two weeks from the RMA date to return the product to the designated Blue BMS warehouse. If the product is not received within this timeframe, the RMA becomes void, and the package will be returned to the sender.
All returned items must be unopened, unused, undamaged, and in their original packaging, with all packing materials, manuals, blank warranty cards, and accessories included. If these conditions are not met, Blue BMS reserves the right to refuse the return or charge a minimum 30% restocking fee. Upon inspection, Blue BMS will issue a credit memo for the full purchase price of the returned product(s).
Blue BMS does not refund shipping charges. Orders over $2,000 are considered special orders and may incur a restocking fee of up to 30%. Blue BMS does not offer cross-shipping; returns must be received and inspected before a replacement is shipped. If a quick replacement is needed, customers are advised to request a refund (if eligible) and place a new order.
Return Instructions
Limited Warranty Policy
Subject to the terms and conditions of this Limited Warranty, Blue BMS warrants that products sold by Blue BMS that are defective in material will be covered under warranty for one year from the invoice date. This warranty does not cover merchandise that, in Blue BMS’ analysis, has been subjected to misuse, neglect, exposure to water, fire, dirt, lightning, paint, contamination, vermin, unauthorized modifications, or accidental damage, nor does it cover repairs made with non-Blue BMS parts.
To submit a warranty claim, customers must complete and return a Warranty Request for the covered product. This request is issued with each covered product and can be obtained via customerservice@bluebms.com. For assistance in completing the Warranty Request, customers may contact the same email.
Upon approval of a warranty claim, an RMA will be issued. However, an RMA does not constitute an approved warranty claim or authorization for reimbursement. Failure to return the product within 30 days of the RMA issuance will result in claim denial, and any attempt to return the product after this period will be refused and sent back at the customer’s expense. Blue BMS is not responsible for unauthorized returns.
For items repaired by Blue BMS, the warranty period remains unchanged and does not restart upon repair. This warranty replaces all other express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Exclusions and Limitations
Blue BMS shall not be liable for any damages beyond the actual amount paid for the product, including but not limited to consequential damages, incidental damages, lost profits, or lost revenue. The following are not covered under the warranty:
For BMSC items, warranties are provided by Blue BMS, not the manufacturer. All warranties are non-transferable without prior written consent from Blue BMS. If Blue BMS determines that an item cannot be repaired or replaced, a refund will be issued in the form of a credit memo. Warranty claim processing typically takes seven (7) business days following approval by Blue BMS’ Technical Department.
In limited cases, for BMPM items, Blue BMS may facilitate a transfer of the manufacturer’s factory warranty. If the manufacturer’s warranty is shorter than one year, Blue BMS will honor its one-year warranty.
Liability and Other Terms
Blue BMS’ sole obligation under this warranty is to refund, repair, or replace the defective product. Under no circumstances shall Blue BMS’ liability exceed the purchase price of the item.
Blue BMS is not responsible for delays caused by factors beyond its control, including but not limited to manufacturing delays, transportation issues, labor strikes, natural disasters, wars, governmental regulations, or other force majeure events. Customers waive any claims related to such delays.
All transactions are governed by the laws of the State of Delaware. Any disputes shall be resolved in the state or federal court closest to Blue BMS’ main office, with both parties agreeing to personal jurisdiction in such courts.
If any part of this policy is deemed unenforceable, the remaining provisions shall remain in full force. Any conflicting terms proposed by the customer are not part of the transaction. Customers must comply with all applicable U.S. export laws, and any transaction violating these laws will be void.
No modifications to this agreement are valid unless in writing and signed by both parties. Neither party may assign rights under this agreement without prior written consent. Waivers are only valid for specific instances and do not constitute a precedent for future cases.
